Representative Cases:
Obtained summary judgment for structural engineer on a claim of promissory fraud. The Plaintiffs alleged that there was a pre-bid promise to send a structural engineer to review the metal hangar submittals on site. Summary Judgment was awarded because the evidence was not sufficient to establish an intent to deceive.
Defended numerous condominium lawsuits in the Florida Panhandle regarding waterproofing of the exterior skin, windows and roof.
Defended and favorably settled a claim against the project architect made by two University of Alabama students who fell from a balcony at an apartment complex in Tuscaloosa when the balcony railing failed.
Defended and favorably settled claim against structural engineer under a governmental contract on Eglin Air Force base where general contractor sued for delays caused design and submittal review.
Obtained summary judgment for geotechnical engineer based on a contract theory over placement of rock buttresses on county road project by general contractor.
